U-Jet: The Regulations states that except for nine scenarios, general aviation missions do not need to undergo application and approval procedures, but it follows that flight plans have to be submitted for approval. Isn’t it self-contradictory?

Jin Junhao: It is not self-contradictory. Under existing airspace management system, general aviation activities are mainly subject to two levels of approval from the Air Force: the “flight mission” approval, where the Air Force decide from a national defense perspective whether or not to grant access to the applied airspace based on the nature of the flight mission, airports to be used, and related airspace; and the “flight plan” approval, where the Air Force decide whether or not approve flight activity for the applied timeframe when the airspace is open for use.

The Regulation defines nine flight activities that require approval and exempt all other flight activities from Air Force and CAAC approval. The Regulation not only eliminates restrictions, but offered greater convenience for applicants by specifying the timeline, procedures, and regulating authority for approval. As to “flight plan” approval, it will be improved in the process of deepening low altitude airspace reform according to the general planning of the National Airspace Management Commission

U-Jet: As you mentioned, the Regulation is mainly about flight mission approval, does it have any relationship with the opening-up of low altitude airspace.

Jin Junhao: The Regulation is issued under the context of China’s deepening reform of low-altitude airspace, streamlining administration, and decentralization. Although it has no direct reference to low altitude airspace, it has made great headway in terms of flight mission management and support. For example, the Regulation states that usage of temporary landing and take-off requires no approval, and the approval for usage of military airports, including military-civil airports, is decentralized to a lower level.

U-Jet: With the Regulation, how much faster would it be for general aviation approval?

Jin Junhao: It is worth pointing out that the Regulation fully exemplified the principle of “no prohibition means permission”, where all activities other than the nine listed are exempted from approval. It is a huge progress. Whereas in the past the approval criteria could result in different interpretations in different hands, today, every scenario is specified to ensure the legitimate interests of general aviation is fairly safeguarded.

U-Jet: What is the legal authority of the Regulation?

 

Jin Junhao: Jointly issued by the PLA General Staff Department and CAAC, the Regulation has the legal force of administrative rules. Based on its implementation and industry feedback, we will, in cooperation with related departments, revise the 1984 Reissuing Regulations on Aircraft Operated Professional Missions issued jointly by the State Council and the Central Military Commission to incorporate the improvements into a State Council administrative regulation.
